These Terms of Use (“Terms”) govern your use of smallcakesocala.com and any orders you place through it. The site is operated by Small Cakes Ocala (“Small Cakes Ocala,” “we,” “us,” or “our”), located at 4701 SW College Rd #106, Ocala, FL 34474.

By using this site or placing an order, you agree to these Terms. If you do not agree, please do not use the site.

Who may use the site

You must be at least 18 years old to place an order or create an account. If you are under 18, you may use the site only with the involvement of a parent or guardian, who is responsible for any order placed.

Ordering from us

We offer two ways to order:

• Pickup. Pickup orders are placed directly on this website and collected at our Ocala shop.
• Delivery. Delivery orders are placed through our online ordering store, which is hosted by Square. When you choose delivery, you leave this website and your order, payment, and delivery are handled on that platform, subject to Square’s own terms and privacy practices in addition to these Terms.

Placing an order is an offer to purchase. An order is not accepted until we confirm it. We may decline or cancel an order for any lawful reason, including product unavailability, a pricing or description error, a problem with payment, or an order we reasonably believe to be fraudulent. If we cancel an order you have already paid for, we will refund it.

Prices, availability and payment

Prices are shown in U.S. dollars and do not include applicable sales tax, which is calculated at checkout. Prices, products, and flavors may change at any time and some items are seasonal or available in limited quantities. Daily flavor availability can vary, and a flavor shown on the site may sell out.

Card payments are processed by Square. We do not receive or store your full card number. By submitting payment you confirm you are authorized to use the payment method.

We make every effort to describe and photograph our products accurately. Decorated items are made by hand, so the item you receive may vary in appearance from the photographs on the site.

Changes and cancellations

If you need to change or cancel an order, contact us as soon as possible at (352) 844-5903 or [email protected]. Because our products are made fresh and are perishable, we cannot always accommodate changes or cancellations once an order is in production.

Custom, catering, and large orders may require a deposit and a minimum amount of notice, and may be subject to separate cancellation terms that we will confirm with you when the order is arranged.

Pickup orders

Pickup orders should be collected at the time and location shown in your order confirmation, during our posted business hours. We hold orders for the remainder of the business day on which they are scheduled. Because our products are perishable, we cannot guarantee that an order left uncollected past its pickup date will be available, and we are not able to offer a refund in that situation.

Delivery orders

Delivery availability, delivery windows, minimum order amounts, and delivery fees depend on your address and are shown before you complete your order. Delivery is fulfilled by a courier service arranged through our ordering platform, not by our staff. Please provide an accurate address and any access instructions. We are not responsible for orders that cannot be delivered, or that are left as instructed and then damaged, spoiled, or taken, because of an incorrect address or delivery instructions.

Allergens and food safety

Our products are made in a kitchen that handles wheat, eggs, milk, soy, peanuts, and tree nuts. We cannot guarantee that any product is free from any allergen, and cross-contact is possible. If you have a food allergy or dietary restriction, please contact us before ordering. You are responsible for reviewing product information and asking us about ingredients if you are unsure.

Our products are perishable and should be handled and stored as advised at the time of purchase.

Gift cards

Gift cards are issued and administered through Square and are subject to Square’s terms. Gift cards may be redeemed for merchandise, are not redeemable for cash except where required by law, and cannot be replaced if lost or stolen.

Your account

If you create an account, you are responsible for keeping your login details confidential and for all activity under your account. Tell us promptly if you believe your account has been used without your permission. We may suspend or close an account that we reasonably believe has been used in breach of these Terms.

Acceptable use

You agree not to use the site to do anything unlawful, to interfere with or disrupt the site or its security, to attempt to gain unauthorized access to any part of it, to use automated means to scrape or copy it, or to submit content that is unlawful, abusive, or infringes anyone’s rights.

Our content

The site and its content — including text, photographs, graphics, logos, and the Smallcakes and Small Cakes Ocala names and marks — are owned by us or our licensors and are protected by intellectual property laws. You may view and use the site for your own personal, non-commercial purposes. You may not copy, reproduce, republish, or use our content for any other purpose without our written permission.

Your feedback

If you send us ideas, suggestions, or feedback about our products or the site, you agree we may use them without restriction and without owing you any payment or credit.

Reviews and submissions

If you post a review or submit content to us or to a page we operate, you confirm it is your own, that it is accurate, and that it does not infringe anyone’s rights. You grant us permission to use and display it in connection with our business.

Links and third-party services

The site links to and embeds services operated by others, including our online ordering store, maps, review displays, and social media feeds. We do not control those services and are not responsible for their content, availability, or practices. Your use of them is governed by their own terms and privacy policies.

Disclaimers

The site is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the site will be uninterrupted, error-free, secure, or free of harmful components, or that any defect will be corrected.

Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, or for fraud.

Limitation of liability

To the fullest extent permitted by law, our total liability to you for any claim arising out of or relating to the site or an order is limited to the amount you actually paid for the order giving rise to the claim, or 100 USD, whichever is greater.

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill, even if we have been advised of the possibility.

Some states do not allow certain limitations, so some of the above may not apply to you.

Indemnification

You agree to indemnify and hold harmless Small Cakes Ocala and its owners, employees, and agents from any claim, loss, or expense, including reasonable attorneys’ fees, arising out of your use of the site or your breach of these Terms.

Governing law

These Terms are governed by the laws of the State of Florida, without regard to its conflict of law rules. Your use of the site may also be subject to other local, state, national, or international laws.

Resolving disputes

If you have a concern, please contact us first — most issues can be resolved quickly and directly. Any dispute that cannot be resolved informally will be brought in the state or federal courts located in Marion County, Florida, and you and we consent to the jurisdiction of those courts.

Severability and waiver

If any provision of these Terms is found unenforceable, it will be modified to the minimum extent necessary and the remaining provisions will stay in effect. Our failure to enforce any right or provision is not a waiver of it.

Changes to these Terms

We may update these Terms from time to time. When we do, we will change the “Last updated” date above. Changes apply to orders placed after the updated Terms are posted. Please check this page periodically.
